Damn… it’s ICEY out here

HELLO everyone! Happy winter. It’s lovely to be back. I know it’s been a while, and you can expect more sporadic posts, but I’m in this thing called college, and it’s kinda time-consuming, so I’ve been living my lovely little life and studying for finals.

Here are some updates: I slipped on the sidewalk today, and I just have been thinking about how badly I want ice off the street.

But hey… don’t we all want ICE off our streets?

Alright, on a more serious note, if you’re at least a tiny bit updated on current events, I’m sure your feed has been blowing up with bystander videos and news coverage on mass ICE workplace raids and increased deportation efforts by the Trump administration.

As is the case with most pressing political discourse, I’m sure we all find the media coverage on this topic pretty overwhelming. Again, it’s meant to be. I know injustice is easier to ignore when it’s not a group of masked officers knocking on your door, but when has silence and reluctance ever led to a positive outcome?

So if you’re concerned and/or confused about the expansion of immigration enforcement and want to know how to help. This article is for you.

Let’s start with the basics: What is ICE meant to be doing?

ICE stands for the U.S. Immigration and Customs Enforcement. As the name suggests, their main job is to enforce lawful immigration within the US. It was founded after 9/11 to keep Americans safe from harmful international efforts. ICE has the right to deport anyone with shaky immigration status; typically, this means recently migrated illegal residents or those with a criminal record. This DOES NOT mean anyone with a green card, but it could mean a permanent resident with a criminal record. Things can easily get a little confusing, so I’ve constructed this table and some definitions to help y’all.

Definitions:

TPS

Temporary immigration status due to instability of one’s home country. This grants permission to work legally, protection from deportation, and eligibility for travel authorization.

DACA

Protects undocumented children from deportation, allows those eligible legal work status and ability to apply for advance parole, that’s a request to travel in advance, and is renewable every two years.

Naturalized

The status of a person who has completed the process of becoming a legal U.S. Citizen.

They must:

 

    1. Have a green card (usually for 3–5 years)

    1. Meet residency and physical presence requirements

    1. Pass background checks

    1. Take the English and civics tests

    1. Attend an interview

    1. Take the Oath of Allegiance

Green Card

Proof that a person is a legal resident of the United States.

Those with Green Cards are allowed to:

 

    • Live permanently in the United States

    • Work legally for any employer

    • Travel in and out of the U.S. (with some rules)

    • Attend school

    • Own property

    • Apply for federal benefits (some, not all)

    • Sponsor certain family members for residency

    • Eventually apply for U.S. citizenship 

Green card holders are often called permanent residents. They cannot vote, and are at risk of losing their status as a permanent resident if they face serious criminal charges.

Stable Legal Status At Risk
• U.S.-born citizens
• Naturalized U.S. citizens
• Individuals with automatic/derivative citizenship through parents
• Green card holders with no serious criminal history
• Approved refugees or asylees without a serious criminal history
• Individuals who maintain a valid visa status and follow visa rules
• Applicants with pending asylum
• Applicants for adjustment of status
• Temporary Protected Status (TPS) applicants
• DACA recipients with active protection
• Individuals granted a stay of removal

• Noncitizens without lawful status
• Visa overstays and violators of terms 
• Those who abandon U.S. residence
• Those who obtained a green card through fraud
• Unauthorized employees
• Those who have violated visa terms
• Individuals denied asylum
• Refugees/asylees with certain criminal convictions
• Individuals with final removal (deportation) orders
• Those who miss immigration court dates (automatic removal orders)

But wait! There are some cute little caveats I should mention here:

ICE can also detain and try to deport green card holders by claiming they are a danger to the United States’ national security or that they are involved in terrorist activities, which is defined very broadly under federal law.

ICE does NOT have to identify themselves as agents OR provide reasons for an indivudal’s arrest right away, they do have to tell someone eventually though.

How have things gone this far?

Illegal immigration is a civil crime, not criminal, meaning ICE doesn’t need as much evidence for an arrest as police do. All they need is an administrative warrant issued by themselves. In some cases, they don’t even need one (when they have reason to believe the accused will flee but cannot use race, profession, or appearance as grounds). To enter a home, they require a judicial warrant (obviously issued by a judge). However, as soon as a person steps outside of their home, they’re free game. Another notable little detail is that ICE is not a branch of the police, which actually gives them more freedom to be sneaky.

Many wear masks and can also falsely identify themselves as policemen or DHS workers to coerce individuals into compliance. They face fewer constraints and less transparency than the police. Those arrested by ICE are also NOT entitled to a government-provided lawyer, and ICE agents don’t need to inform their family of their location immediately. 

Hold on.. did Trump start this ICE shit?

No, actually, surprisingly, ICE is not an infringement on the safety and well-being of Americans when someone else is in presidency!

Under the Obama Administration, ICE carried out highly coordinated and researched deportation efforts, prioritizing the worst first, meaning they focused on deporting criminals who posed a threat to American citizens. They still conducted raids, so those didn’t just start with the Trump administration. In 2021, President Biden ended large-scale worksite raids and focused on enforcing the IRCA’s prohibition against hiring unauthorized workers. However, widescale worksite immigration raids restarted under the Trump administration in January of this year and have only grown in severity. 

The basic simplification of things is that Trump’s trademark movement was to pilot the largest mass deportation effort the world has ever seen. And to our surprise, he’s actually holding to his promise.

Which leads us to now…

The Trump administration is currently targeting green card holders with past criminal records and some political activists who express opinions the administration doesn’t like. Recently, ICE has been storming into immigration courts and green card interviews to capture and deport those with a shaky citizenship status.

What’s more is in the first seven months of the second Trump administration, ICE has publicly reported at least 40 worksite enforcement actions resulting in over 1,100 arrests. These enforcement actions typically resulted in fewer than 100 arrests per operation and have occurred across a range of industries, often targeting those with a high concentration of noncitizen workers, including restaurants, car washes, automotive repair shops, bakeries, and nail salons.

In June of this year, they arrested an average of 1200 individuals per day. The Guardian reported an 807% increase in the number of those arrested by ICE without a criminal record. There are also over a thousand local departments that have agreed to work with ICE and aid in their jacked deportation efforts. See the websites below for more information.

What this looks like in action

A Texan college student named Lopez Belloca was deported after traveling from Honduras to Texas as a Thanksgiving surprise. Apparently, her status as a citizen had been removed since she was a child; the courts just never warned her until she was arrested on site. Her attorney argued that she never knew about the longstanding removal order let alone how to challenge it. Immigration and Customs Enforcement made it nearly impossible to locate her as she was being deported.

Two sisters were among a group of 9 car wash employees taken by ICE. Each individual was thrown into a van, triple shackled, and shipped off to ICE facilities with no immediate familial contact permitted. Their lawyer stated that they have legal status and valid documentation, but ICE refused to let them produce it on scene.

“It’s an abuse of government power — taking people, depriving them of access to attorneys, access to medication and just sheltering them away and hiding them from society, hoping nobody is going to do anything about it and we’re all going to look the other way,” their lawyer said. Read more below.

Okay, this is super dark stuff considering our government is funding 170 billion dollars dedicated to mass deportation. Just take a second to digest this instead of shoving it down in favor of more light and bubbly topics. I’m here with you in the shock of it all. I have some resources listed about what ICE can and cannot do, as well as how to protect yourself and others from ICE if you see them on the streets.

You can let this be overwhelming, you can take breaks from the news, you can be upset and scared. But if you look away, please understand that’s part of the problem. I hate to leave things on a depressing note, so we have some moral support baddies to end the blog with us today.
